Putnam Commission Does Not Want To See Red Flag Laws Enacted At Special Legislative Session

The Putnam County Commission does not want to see Red Flag Laws enacted at the special legislative session this month.

According to House Bill 1574, the law as introduced, allows a court to issue a risk protection order upon  finding  clear and convincing evidence that a person poses a significant danger of causing personal injury to the person or others if allowed to possess or purchase a firearm.

Commissioner AJ Donadio put forward the resolution in the Planning Committee Session Monday night. He said he wants the county’s representatives to Nashville to vote against a resolution.

Tennessee is not the place for red flag laws, our Second Amendment is sacrosanct to us in this state,” Donadio said. “And I’m asking our elected delegation to the state level to vote against any red flag laws that come across their desk.”

Donadio said currently under the due process of the 14th amendment if you are convicted of certain crimes your Second Amendment rights can be taken away. He said that includes felonies.

“Red flags reduce that to an accusation and a judge can take away your second amendment rights without due process, and that cannot be tolerated,” Donadio said.

The motion passed unanimously in the planning commission and once again in the full county commission. Donadio asked for a roll call vote of the entire commission, meaning all names were on record with the vote.
